Former deputy governor of Adamawa state, Mr James Bala Ngilari, has approached a Federal High Court in Abuja, asking it to declare him as the governor of the state after the impeachment of his boss, former Governor Murtala Nyako.
Ngilari is also asking the court to declare that the acting governor, Ahmadu Umar Fintiri is illegaly occupying the office
of the governor of the state.
Ngilari was said to have resigned shortly before the Adamawa State House of Assembly impeached Nyako.
In a suit filed through his lawyer, Mr. Festus Keyamo, Ngilari also named Fintiri, acting Speaker of the state House of Assembly, Ahmadu Umar, the state Assembly and Nyako as co-defendants.
In the suit, Ngilari is further asking the court to determine whether by the provisions of sections 306(1), (2) & (5) of the 1999 Constitution (as amended) he, as Deputy Governor of the state, resigned his office by addressing a letter of resignation
dated July 15, 2014 to the state Assembly.
He is also asking the court to hold that by the combined provisions of section 306 (1), (2) and (5) of the Constitution, he did not resign his office by addressing a letter of
resignation to the Speaker of the state Assembly.
Ngilari also claimed that he did not submit any letter of resignation to his former boss other than the state Assembly.
No date has been fixed for the hearing of the matter.
